We had proof of that and as long as you have proof you can terminate that employee.
Now you have to be careful about charging that employee for the cost of that issue because wage and hour laws dictate how that employee gets paid, but you are within your rights and you are legally allowed to terminate that employee struggling with employee liability problems.
