W2 or 1099, which one is legal for you? Got a call from a client just starting out and they’re going to be having folks work for, for them for just a few hours a week, maybe a couple of days a week. So they thought they could pay them as an independent contractor. That’s not up to them. It’s up to the Department of Labor and the IRS that determines whether somebody is a contractor or an employee.
It depends upon the job duties. It depends upon their financial situation, whether they work for other businesses, so they have their own business.
Those are all the questions that need to be asked. After I questioned my client on that, the folks that were gonna hire as contractors needed to be hired as employees. They were only gonna be working for them with the opportunity to grow into full-time positions as their business developed. Know the difference.
