The difference between exempt and non-exempt, and that’s defined by the Department of Labor, it is not defined by the employer or the owner. There are different classifications of exemptions. There can be an executive exemption, an administrative, a professional, a sales. And so the important thing is to go on the Department of Labor’s website and read the fact sheet that defines each of those classifications to determine whether a position should really be exempt or non-exempt. Non-exempt means They’re not exempt from overtime.
