Garnishment notices got you down, let’s talk. So a client was served with a garnishment from a court. It was a court order, and they didn’t know what they were supposed to do. So the process is the employer can be held liable for that amount of money that that employee’s being garnished if they don’t take action on it.
So the employer needs to inform the employee that they were served with the garnishment, advise them that they need to respond to the notice, and then they need to deduct an amount that is in that notice until it is paid in full. If the employer does not do that, the employer can get into a lot of trouble and they could be liable for that amount. So I encourage all employers to take those garnishments seriously and take action. But I do wanna say you wanna let the employee know what’s happening so that if they can make arrangements before you start taking the funds out of their paycheck, they can take care of it. But you must respond to those notices and you must comply.
