All right. This is interesting. They did not violate wage and hour supposedly, unless yesterday was the end of a work week and today was the start of another work week. If that were the case, they would’ve needed to pay him his overtime from yesterday because it was the end of the work week. He can’t make it up in another work week.
However, if it was within the same week, they’re certainly within their rights. It’s called Flex Time, and therefore he worked an extra five hours one day, so he’s gonna work five hours less the next day. So again, we have to find out exactly when the end of the pay period was to see if there was a violation of wage and hour.
