Veronica is absolutely correct.
She should not have to download an app to have her emails on her phone. If it is a requirement of the job, then she should get either on-call pay, or she should be paid for the time she spends checking emails after hours. There is absolutely no reason why she should be checking emails after hours or the expectation of her to check those emails after hours.
And if there were an expectation, it should have been in writing. That is not the case. She is not to download that app and she is not to check emails, unless the company agrees to pay her for the time she spends after hours.
